Terms and Conditions
The rules and responsibilities that apply when you use VancedSelf.
Interim document: These Terms identify the operator and support email, but do not currently publish a mailing address. Complete the address and governing-jurisdiction details and obtain legal review before forming an LLC or relying on these Terms as final legal documents.
1. Agreement and eligibility
These Terms and Conditions (the “Terms”) are an agreement between you and Jonathan Fernandes, operating as VancedSelf (“VancedSelf,” “we,” “us,” or “our”). They govern your use of the VancedSelf website, mobile application, content, and related services (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be legally able to enter into a binding agreement. If you are under the age of majority where you live, use the Service only with a parent or legal guardian’s permission and supervision. The Service is not directed to children under 13, or any higher age required by local law.
2. Permitted use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable right to use the Service for personal, non-commercial purposes. You may not copy, sell, rent, sublicense, reverse engineer, disrupt, scrape, bypass security, introduce malicious code, or use the Service to violate law or another person’s rights.
3. Accounts and user content
You are responsible for accurate account information, keeping credentials secure, and activity under your account. You retain ownership of content you submit, including goals, entries, and notes (“User Content”). You grant us the limited license needed to host, process, display, back up, and provide the Service, in accordance with our privacy practices. You represent that you have the rights needed to submit User Content.
4. Subscriptions, renewals, and refunds
Paid plans, trials, and in-app purchases display their price, billing interval, trial duration, renewal terms, taxes, and included features before purchase. Unless cancelled before renewal, a subscription renews for the same period and the applicable payment provider or app store may charge your payment method. Manage cancellation through the store or provider used for purchase; deleting the app does not necessarily cancel a subscription.
Refunds are handled under the applicable app-store or payment-provider rules and any mandatory rights under local law. We may change prices or features prospectively and will provide notice or cancellation rights where required. If a trial or promotion is offered, its specific terms control.
5. Health and wellness disclaimer
VancedSelf provides general fitness, nutrition, mindfulness, habit-building, and productivity information for educational purposes only. It is not medical advice, diagnosis, treatment, or emergency care, and no professional relationship is created. Consult a qualified professional before changing exercise, diet, or treatment. Stop an activity and seek appropriate medical help if you experience pain, distress, or concerning symptoms. In an emergency, contact local emergency services.
6. Intellectual property and feedback
The Service, including its software, design, text, graphics, trademarks, and content supplied by us, is owned by or licensed to VancedSelf and protected by intellectual-property laws. Except for the limited right granted in these Terms, no rights are transferred. If you provide suggestions or feedback, you allow us to use it without restriction or compensation, without publicly identifying you without permission.
7. Privacy and third parties
Our collection and use of personal information is described in our Privacy Policy. Review that policy before using the Service; publish it before collecting personal information if it is not yet available. App stores, payment processors, analytics providers, and linked services have their own terms and privacy policies, and we are not responsible for third-party services or content.
8. Availability and termination
The Service may change, be interrupted, or contain errors. We do not promise uninterrupted, secure, error-free, or universal availability. You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to protect the Service, enforce these Terms, prevent misuse, comply with law, or address non-payment. Provisions that should survive termination will continue to apply.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties not expressly stated in these Terms. To the maximum extent permitted by law, VancedSelf will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of data, profits, or business arising from the Service. Nothing excludes or limits liability that cannot legally be excluded, including mandatory consumer or personal-injury rights.
10. Changes to these Terms
We may update these Terms as the Service or law changes. We will post the revised version and update the date above. For material changes, we will provide notice where required. Continued use after the effective date means you accept the revised Terms.
11. Governing law and disputes
These Terms are governed by the laws of New Jersey, United States, without regard to conflict-of-law rules. Disputes will be handled by the courts or dispute-resolution process required or permitted by applicable law, including any mandatory consumer rights in your place of residence.
